Enquiry: What are the special requirements that apply when manufacturing, importing or operating outsized recreational equipment in China?
In China, in accordance with the Special Equipment Safety Law, the Regulations on Safety Supervision of Special Equipment, and the Regulations on the Safety Supervision of Large Amusement Facilities, large recreational facilities come under the special equipment category. With regard to the manufacture, design, installation, upgrade or repair of any such equipment, it is incumbent upon the company concerned to satisfy all of the conditions detailed under the terms of the applicable legal requirements, while also securing the approval of the individual supervisory department responsible for the safety supervision of such equipment. In the case of the import of any large recreational equipment, the importer must first ensure compliance with all of China’s safety and technical standards, with final approval dependent on the subsequent inspection of said equipment.Furthermore, in order to fully comply with the Regulations on the Safety Supervision of Large Amusement Facilities, all operators of such equipment are obliged to register with the relevant local quality and technical supervision department. They must also arrange an initial in situ visit by the appropriate inspection body and agree to future monitoring on a regular basis. In addition, an appropriate safety management system should be agreed and maintained and a pre-operation run of all equipment should be standard procedure. Finally, all operators are obliged to implement a daily inspection and maintenance regime, conduct regular safety inspections and keep due records in accordance with the technical safety code and the pertaining operational / maintenance guidelines.
