Is prior approval necessary when establishing elderly-care facilities in China?
Under the terms of the recently-amended Law on the Protection of the Rights and Interests of the Elderly, interested parties no longer need to apply for a permit when looking to establish elderly-care facilities. Those intending to establish private, non-profit elderly-care institutions, however, still need to complete the requisite registration and record-filing procedures.
Currently, all such procedures are administered by the civil affairs department of the relevant local government at (or above) the county level in accordance with the Interim Regulations on the Registration Administration of Private Non-Enterprise Units.
