Q: Can Foreign Investors Set Up Wholly-owned Advertising Companies in China?

A: Currently, foreign investors are allowed to set up wholly-owned advertising companies in the mainland offering all or some of the following services: design, production, distribution, as well as acting as agent for various kinds of ads at home and abroad. Wholly foreign-owned advertising companies should meet the following conditions:

1. The core business of the investor must be advertising services;
2. The investor must be established and in operation for at least three years;
3. Hong Kong and Macau service providers may act as corporate legal person for the operation of advertising business (including non-core business).

The investor must apply to the local industry and commerce administration bureau for approval to establish a foreign-invested advertising enterprise. Once permission is granted, an Opinion on the Approval of Foreign-invested Advertising Enterprise Project will be issued.
