Online CBA: We are a Member of the China Commodity Bar Code System. Can Our Company Prefix and Corresponding Commodity Bar Codes be Transferred to and Used by Other Parties?

Q: We are a member of the China Commodity Bar Code System. Can our company prefix and corresponding commodity bar codes be transferred to and used by other parties? If not, what are the penalties for violation?

A: No. The Measures for the Administration of Commodity Bar Code stipulates that members have the exclusive right to use their company prefix, commodity item codes and the corresponding commodity bar codes. However, it should be noted that having the exclusive use rights is not ownership. Therefore, members cannot let other parties use their company prefix and corresponding commodity bar codes. Members found to have done so will be ordered to rectify the situation; gains from such improper acts shall be confiscated and a fine imposed. “Transferees” will be ordered to rectify the situation and pay a fine.
