What are the mainland’s specific regulations regarding the production, import and operation of large-scale recreational facilities and other special equipment?
According to the Special Equipment Safety Law of the People’s Republic of China, the Regulations on Safety Supervision for Special Equipment, and the Provisions on the Safety Supervision of Large-Scale Recreational Facilities, large-scale recreational facilities fall within the Special Equipment category. In line with this, all aspects of the production (including design, manufacture, installation, modification and repair) of said equipment must comply with all prevailing legal requirements, including being licensed by the appropriate special equipment safety supervision department. In addition, importers of large-scale recreational equipment must ensure all such items comply with China’s safety and technical standards and undergo any due inspection, while also being appropriately licensed. Furthermore, in accordance with the Provisions on the Safety Supervision of Large-Scale Recreational Facilities, any party operating such equipment must be registered with the local quality and technical supervision department. They must also undergo an initial inspection by the appropriate special equipment inspection authority, as well as any required subsequent inspections. In terms of operational responsibilities, it is incumbent upon them to implement a satisfactory safety management system; conduct pre-operation trial runs, ensure daily safety checks are completed, carry out any required repairs and observe due maintenance. In accordance with the mainland’s safety and technical standards and statutory maintenance regime, all such checks and repairs must also be comprehensively documented.
