China Adopts New Elderly-Care Establishment Approval Procedures

As of 2 January this year, enterprises have no longer had to apply for a permit prior to establishing an elderly-care institution, with the requisite registration and record-filing procedures now deemed to suffice.

The change forms part of the amended Law on the Protection of the Rights and Interests of the Elderly, as recently-endorsed by the National People’s Congress Standing Committee in a bid to encourage private investment in the elderly-care sector.

Among the headline changes are the following:

  • At all levels, civil affairs departments will no longer accept applications related to the establishment of elderly care institutions. Any permits already obtained through such channels will remain valid, but cannot be renewed via the same means
  • In future, all applications relating to the establishment of private, non-profit elderly care institutions must be conducted via the requisite registration and record-filing procedures, as administered by the civil affairs department of the relevant local government, at or above the county level, in accordance with the Interim Regulations on the Registration Administration of Private Non-Enterprise Units
