China Mandates Annual Reporting Responsibilities for Foreign-Invested Enterprises

New regulations relating to the conduct and reporting responsibilities of foreign-invested enterprises (FIEs) operating within China have been jointly issued by the Ministry of Commerce, the Ministry of Finance and four other government departments.

The three core requirements outlined in the circular are as follows:

  • During the period 1 April 2018-30 June 2018, every FIE registered within China must submit details of their 2017 investment and business operations via the System for the Joint Reporting of Information on Annual Investment and Business Operations of FIEs Nationwide (www.lhnb.gov.cn). The information will then be distributed to the relevant government bodies, including the departments of commerce, finance, taxation, quality and technical supervision (market supervision and management), statistics and foreign exchange administration
  • Any FIE established during the course of 2018 will be obliged to submit details of its investment and business activities for the current year in 2019 and then subsequently for every year that it continues to operate
  • In line with the Interim Provisions on Enterprise Information Disclosure, any such information submitted by FIEs will be publicly accessible via the Ministry of Commerce’s online platform (lhnbgs.mofcom.gov.cn)
