Comprehensive Regulatory Regime Introduced for Mainland Live Streaming Services

Mainland-based online streaming services have been ordered to comply with strict new regulations as the government looks to bring the sector under more formal control. As a first step, under the terms of the new regime, all online live streaming service providers are obliged to complete website internet content provider (ICP) filing formalities with the appropriate telecommunications authority.

Additionally, all online live streaming services providing telecommunications business operations, internet news information, online performances, online audio-video programming or other such content needs to secure the required individual licence for each respective area of content – i.e. a licence for telecommunications business, a licence for internet news information services etc. In line with this, in the case of each licence, the required public security filing formalities must be completed with the presiding public security department within 30 days of any streaming service going online.

Providers of internet access service operations, internet data centre operations and content distribution network services are prohibited from providing network access services to any online live streaming service provider that has not completed the requisite ICP filing formalities and/or not secured the relevant operating licences. Similarly, mobile app digital distribution platforms must also ensure that all content providers have the required documentation in place prior to entering into any agreement with them.

Full details of these new requirements were published in the recent Circular on Strengthening the Management of Online Live Streaming Services, as jointly issued by six government departments, including the National Office Against Pornography and Illegal Publications, Ministry of Industry and Information Technology, Ministry of Public Security and State Internet Information Office.
