Guangdong Set to Align with National Market Access Negative List Requirements

All Guangdong businesses must now ensure they are in compliance with the requirements of the National Market Access Negative List, with the province-specific Industry Access Negative List for the Major Function Zones of Guangdong (2018 Edition) (Yue Fa Gai Gui No. 12 [2018]) having been repealed. The move is in line with plans to ensure the national adoption of a single market access negative list, as outlined in a 20 August circular jointly issued by the Guangdong Development and Reform Commission and the Guangdong Department of Industry and Information Technology.

In terms of particular requirements, Guangdong companies must look to enhance both operational and post-operational oversight with regard to regulating their investment activities. In the case of capacity replacement projects in industries where a serious overcapacity currently exists, records must be filed with the appropriate investment department in cities at the prefecture level or above once any capacity replacement procedure has been completed.
